Traffic Collision reports are required to be released pursuant to Vehicle Code Section 20012. The agency cannot refuse to release Traffic Collision Reports under the reasoning that they are part of the police report and/or arrest report. Thus, you need to be specific when requesting a Traffic Collision Report and not confuse it with requesting a police and/or arrest report, as police reports and arrest reports are not required to be released.

HUNTINGTON BEACH CITY JAIL - PAY-TO-STAY JAIL PROGRAM

The Huntington Beach Police Department provides a "pay-to-stay" program that allows defendants to serve their time if convicted of a multiple offense DUI in a private city jail, not County Jail. That program ended briefly during COVID, which temporarily removed that avenue to avoid serving jail in the Orange Count Jails and thus made it more difficult to find ways for defendants to serve their jail time in a low-risk facility and to be permitted to continue working, an option not provided if you have to serve actual jail time.

The Huntington Beach Police Department City Jail has a solid reputation for providing a safe environment in which to serve any jail time that may be required if you are convicted of a second, third or even fourth offense DUI. Offenders serving their time in a pay-to-stay inmate worker program are often permitted to leave the premises daily to go to work, attend school, or to do community service or attend an alcohol program, while attending the pay-to-stay inmate worker program.
