Details You Should Know About DUI Drug Charges

An emerging area of DUI is the DUI-D, or Driving Under the Influence of Drugs, charge under what was previously Vehicle Code Section 23152(a)-driving under the influence of alcohol and/or drugs; however, in 2014 two new statutes were enacted: Vehicle Code Section 23152(e), driving under the influence of drugs, which includes all prescription medications, and Vehicle Code Section 23152(f), driving under the combined influence of alcohol and drugs.

There are companion statutes to the standard DUI Drug charges when there is an accident or traffic collision involved that causes injury to another person or persons, (commonly referred to as DUI With Injury and/or Great Bodily Injury), which can be found under Vehicle Code Section 23153(e) and Vehicle Code Section 23153(f).

In DUI Drugs cases, the prosecution must prove that the medication was actually causing impairment. The fact that the person took the drug does not mean that the person was actually impaired by the drug. That said, the Orange County District Attorney's Office began actively pursuing cases involving DUI Drugs, assigning a team of "Special Prosecutors" to prosecute these types of cases, in 2010. That the Orange County District Attorney's Office has created specialized prosecution teams to pursue these types of cases means that the chances of being charged with a DUI when a person is taking drugs and/or prescription medications is heightened.

There are numerous defenses available in DUI Drug cases because every person reacts differently to drugs, particularly to prescription medications. Because of this, for the Orange County District Attorney to obtain a conviction it must be shown that the prescription medication or drug effected your ability to drive a motor vehicle in a manner consistent with that of a sober person. As opposed to the case of just alcohol, this is not as easy of a case to prove in many instances. This demonstrates the need for an experienced DUI Drugs attorney to represent you if you happen to be charged with driving under the influence of drugs or the combined influence of alcohol and drugs in Orange County, California.
