THE GALLATIN DUI STUDY

I found the Preliminary Report from the Gallatin County Study news report that was published on January 21, 2016 in the Bozeman Daily Chronicle interesting. The report analyzed the trends in DUI numbers, among other things and came to the following conclusions - some surprising and others expected.

It revealed that that the most commonly charged defendants were between the ages of 18 and 29, which surprised me in light of many of this age groups’ familiarity with Uber and Lyft – two services for which seemingly everyone in their age group would be familiar and uses frequently.

The study found that those cited were most commonly cited between midnight and 3 a.m., which was of little surprise. What was surprising, however, was that of the 337 cases in which defendants provided a breath sample, the average blood-alcohol content was 0.177, more than twice the legal limit.

The study also revealed that the roads where most DUI offenders were pulled over were the roadways with the most traffic. While this is not surprising, it is interesting that DUI drivers do not tend to search for less-traveled roadways.

COMPLIANCE CONSIDERATIONS

The report also delved into how many of the DUI defendants were compliant with their pretrial release conditions, how many initially pleaded not guilty compared to how many were eventually convicted, the lengths of the sentences, and even a break-down by age of the blood-alcohol content of defendants. Fortunately, the data showed DUIs were being taken seriously and this is what the legislatures have determined to be the goal: to reduce recidivism by imposing DUI Penalties that are so severe that they serve as a deterrent for future conduct.
